This article aims to present the emergence and the problems which the concept of Thatsache or fact of consciousness attempts to solve in the development of elementary philosophy in its early years. To accomplish this task four texts will be analyzed in three steps. Primarily, the investigation focuses on the difference between internal and external conditions of representation in relation to the mere representation and the problems which it rises in his Essay on a new theory of the human capacity (...) of representation. Secondly, the article analyses how Reinhold tries to solve these problems through the concept of fact of consciousness proposing a definition to the representation as a proposition in his On the possibility of philosophy as rigorous science and New presentation of the chiefs moments of elementary philosophy, both present in the Contribution to the correction of previous misunderstandings of the philosophers. Thirdly, how this concept works not only as a principle of consciousness, but also as a ground to elementary philosophy and the philosophy as well, especially in the On the foundation of philosophical knowledge, known just as Fundamentschrift. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Philosophy Imprisoned: The Love of Wisdom in the Age of Mass Incarceration draws together a broad range of philosophical thinkers, from both inside and outside prison walls, in the United States and beyond, who draw on a variety of critical perspectives (including phenomenology, deconstruction, and feminist theory) and historical and contemporary figures in philosophy (including Kant, Hegel, Foucault, and Angela Davis) to think about (...) prisons in this new historical era. All of these contributors have experiences within prison walls: some are or have been incarcerated, some have taught or are teaching in prisons, and all have been students of both philosophy and the carceral system. The American environmental movement has a longstanding tradition of respect for American Indians. Recently, however, there has been a noticeable erosion of that tradition. The most volatile issues in the Indian/environmentalist controversey at present are those involving the right of many Indians to hunt and fish unrestricted by state or federal conservation regulations. Especially where endangered species areinvolved, some environmentalists have been quick to recommend that this unique privilege accorded to Indians be curtailed. While I share a deep concem for (...) the preservation of endangered species and ecosystems, I suggest that the environmental movement has so far been insensitive to the concems of the American Indian community. Rather than simply seeking to take away rights to which Indians havebeen entitled for decades, environmentalists should be prepared to negotiate on such matters. As an example, I suggest that-in exchange for the Indians’ voluntary surrender of some of their treaty rights--environmentalists might agree to seek legislation opening national forest lands to Indians who wish to live subsistence life styles, as some Alaskan wildemess lands are now open to the Inuit. Might discoveries in the natural and human sciences open creative possibilities for theology, and vice versa? Can Christian theology maintain its integrity while integrating insights from other disciplines? Theology as Interdisciplinary Inquiry takes up these questions as its central aim. This volume of six essays emerges from a three-year Templeton Foundation initiative that brought an interdisciplinary set of scholars together at the Center for Theological Inquiry to explore how their research might collaboratively push theology in new directions. These conversations centered on three themes: evolution and human nature, religious experience and moral identity, and law and religious freedom.In the first essay, Celia Deane-Drummond proposes an alternative approach to traditional readings of the Genesis creation account that looks to "resonances" between von Balthasar's notion of "theo-drama" and niche construction theory. Her argument allows for human agency while drawing theology into a complementary, rather than conflictual, relationship with evolutionary science. The next three essays take up the theme of religious experience and moral identity. Michael Spezio proposes that both theology and cognitive science look to moral exemplars as the phenomenological basis for more realistic and mutually informative moral theology and cognitive models of learning. Colleen Shantz draws on cognitive science to demonstrate how the material [End Page 192] and relational are constitutive of cognitive processes, arguing that it is precisely through "development and change" that we bear the imago Dei (66). Andrea Hollingsworth offers a rereading of Nicholas of Cusa's De visione Dei to demonstrate how a medieval mystical text echoes elements of contemporary neurocognitive processes of self-transformation. The final two essays center on law and religious freedom. John Burgess examines the privileging of religious freedom for canonizing martyrs in post-Soviet Russian Orthodoxy, arguing that this provides theological grounding for the legal right to religious freedom. Mary Ellen O'Connell proposes aesthetics as a more adequate modern grounding for legal authority than science. She argues that aesthetics takes us beyond the limits of self-interest, drawing us into concern for the good of others through the contemplation of beauty.What holds these essays together is the pursuit of "transdisciplinarity": "paying close attention to the other discipline(s) in a way that has a substantial and mutual impact, but at the same time retaining a clear sense of disciplinary integrity" (14–15). Lovin and Mauldin argue for humility and hope as virtues that enable us to navigate the tension between openness and integrity. While humility enables us to recognize the limits of disciplinary boundaries and assumptions, hope propels us forward, promising that however incomplete our knowledge remains, by the grace of God we will make advances in understanding our world and ourselves.Just as Christian Scharen and Aana Marie Vigen's Ethnography as Christian Theology and Ethics argues for the value of engagement with ethnography and its related disciplines to produce theology and ethics grounded in lived reality, this volume argues for the value of engagement with the natural and human sciences to produce "theological realism" that accounts for the complexity of "human personality and community" (xviii). It is unsurprising, then, that both volumes respond to objections from the neo-Radical Reformation and Radical Orthodoxy camps. In his conclusion, Douglas Ottati argues that these camps cannot account for the ways in which theological production inevitably interacts with natural and cultural processes. He argues further that insulating Christian theology is a form of cultural accommodation because it mirrors the formation of discrete modern disciplines, the very limitation these essays seek to transcend.This volume advances the live discussion in Christian ethics about the promise and risks of engaging natural and social sciences. This article describes some historical precursors that led to William James’s participation in the Hibbert Lectures and his subsequent publication of A Pluralistic Universe. William James viewed the monism–pluralism issue as the greatest issue the human mind can frame, and he returned to this issue again and again in his psychological and philosophical works. The Hibbert Lectures afforded an opportunity to explore the problem of monism and pluralism in a broadly religious or spiritual context. We describe James’s logical (...) and experiential attacks on monistic thinkers, his seemingly paradoxical introduction of Gustav Fechner’s panpsychism to English-speaking philosophers, and his spirited defense of pluralism. We conclude by discussing the relevance of James’s pluralism for current questions of unification in psychology. (shrink)

The paper examines constraints and preferences employed by people in learning decision rules from preclassified examples. Results from four experiments with human subjects were analyzed and compared with artificial intelligence (AI) inductive learning programs. The results showed the people's rule inductions tended to emphasize category validity (probability of some property, given a category) more than cue validity (probability that an entity is a member of a category given that it has some property) to a greater extent than did the AI (...) programs. Although the relative proportions of different rule types (e.g., conjunctive vs. disjunctive) changed across experiments, a single process model provided a good account of the data from each study. These observations are used to argue for describing constraints in terms of processes embodied in models rather than in terms of products or outputs. Thus AI induction programs become candidate psychological process models and results from inductive learning experiments can suggest new algorithms. More generally, the results show that human inductive generalizations tend toward greater specificity than would be expected if conceptual simplicity were the key constraint on inductions. This bias toward specificity may be due to the fact that this criterion both maximizes inferences that may be drawn from category membership and protects rule induction systems from developing over‐generalizations. William Scott Douglas's six volume edition of Burns's work is the most oustanding of all the nineteenth century editions in terms of completeness and scholarship. The first three volumes contain Burn's poetry, and the prose works in the final volumes include some sixty-eight previously unpublished letters or parts of letters.

Floods generate both risks and benefits. In Langhorne Creek, South Australia, a historically-embedded system of shared floodwater management exists among farmers, who rely on semi-regular flood inundations as part of the region’s hydrosocial terroir – a dynamic conjunction of water, landscape, social relations and agricultural practice. Unruly floods coexist with a heavily regulated and precisely measured system of modern water management for viticultural irrigation across the region. Since the mid-twentieth century, groundwater extraction and new pipeline schemes have linked Langhorne Creek (...) to the Murray Darling Basin water management system, which has displaced flooding as the primary source of irrigation water. The associated modernist shift towards the rationalization of water as a measurable resource has acted to sideline flood irrigation. Yet, floods maintain important viticultural, ecological and social roles in Langhorne Creek, adding to the flexibility and resilience of the region in response to water management challenges. The system involves technological and infrastructural components, such as flood gates and channels, but also relies upon the cooperation and coordination of community members. Local vignerons suggest that flood irrigation is environmentally as well as economically beneficial, rejuvenating riparian wetlands along watercourses. A more formal acknowledgement of the specific regional experiences of water management in a wine region like Langhorne Creek helps to fill a gap between emplaced and hydrosocial understandings of flood irrigation and broader assumptions about flooding as wasteful and inefficient. Care theory's efforts to valorize care have depended upon the development of a minimally coherent conception of “care.” Despite many disagreements, there is a shared assumption that care is the Other to concepts and activities that are male-dominated and so better paid, more powerful, and included in instead of excluded from politics. However, such an assumption ignores the other, noncaring forms of labor women do, which are likewise underpaid, exploited, and excluded from politics. This becomes a problem when care theorists (...) propose greater inclusion for care workers, for example Joan Tronto's argument to extend citizenship on the basis of care work, because it does not consider the hierarchies it may reproduce between care and its Others, especially feminized commodity production. Using Dorothy Roberts's distinction between spiritual and menial housework, I argue that care theory is susceptible to perpetuating hierarchies among women. Extending Roberts's argument, I argue that the care/noncare division of feminized labor reproduces hierarchies among women in the Global South, and between consumers and producers. Although we do not need to abandon the category of care altogether, we do need to address care's exclusions and its relationship to other forms of feminized labor. (shrink)

Patient autonomy, as exercised in the informed consent process, is a central concern in bioethics. The typical bioethicist's analysis of autonomy centers on decisional capacity—finding the line between autonomy and its absence. This approach leaves unexplored the structure of reasoning behind patient treatment decisions. To counter that approach, we present a microeconomic theory of patient decision-making regarding the acceptable level of medical treatment from the patient's perspective. We show that a rational patient's desired treatment level typically departs from the level (...) yielding an absence of symptoms, the level we call ideal. This microeconomic theory demonstrates why patients have good reason not to pursue treatment to the point of absence of physical symptoms. We defend our view against possible objections that it is unrealistic and that it fails to adequately consider harm a patient may suffer by curtailing treatment. Our analysis is fruitful in various ways. It shows why decisions often considered unreasonable might be fully reasonable. It offers a theoretical account of how physician misinformation may adversely affect a patient's decision. It shows how billing costs influence patient decision-making. It indicates that health care professionals' beliefs about the ‘unreasonable’ attitudes of patients might often be wrong. It provides a better understanding of patient rationality that should help to ensure fuller information as well as increased respect for patient decision-making. (shrink)

This study examined the influence of corporate giving programs on the link between certain categories of corporate crime and corporate reputation. Specifically, firms that violate EPA and OSHA regulations should, to some extent, experience a decline in their reputations, while firms that contribute to charitable causes should see their reputations enhanced. The results of this study support both of these contentions. Further, the results suggest that corporate giving significantly moderates the link between the number of EPA and OSHA violations committed (...) by a firm and its reputation. Thus, while a firm's reputation can be diminished through its violation of various government regulations, the extent of the decline in reputation may be significantly reduced through charitable giving. In this dissertation, I argue that commonsense morality is best understood as an agent-relative consequentialist theory, that is, as a theory according to which agents ought always to bring about what is, from their own individual perspective, the best available state of affairs. I argue that the agent-relative consequentialist can provide the most plausible explanation for why it is wrong to commit a rights violation even in order to prevent a number of other agents from committing comparable rights violations: agents (...) bear a special responsibility for their own actions and consequently a state of affairs where an agent has herself committed a rights violation is worse, from her perspective, than a state of affairs where a number of other agents have committed comparable rights violations. I also argue that agent-relative consequentialism can accommodate moral options despite being a theory which requires agents always to do the best they can. (shrink)

This article traces the career arc of Dutch psychoanalyst Joost A. M. Meerloo by examining his biography and his psychology of interrogation and confession. His life story, particularly his experiences during the German occupation of the Netherlands and his escape to England during World War II, shaped his views on these issues, as well as his rise to prominence as an expert on these topics in the United States. His psychoanalytic perspectives on interrogation and confession, including false confession, reflected the (...) zeitgeist of the First Wave of Cold War interrogation tactics and related scholarship. His career as a scholar of interrogation faded with the study of distinct interrogation tactics used by communists during the Korean War, the emergence of experimental social psychology, and a growing cohort of scholars who rejected his psychoanalytic views in favor of more contemporary approaches. For these reasons, his work remains undervalued, increasing the risks that today’s scholars will fail to recognize his larger contributions and his warnings about vulnerability and psychologists’ roles in military interrogations. The article reviews the rise and fall of the career of Joost A. M. Meerloo as a scholar of Cold War interrogation, including his contributions and his unheeded warnings about vulnerability and psychologists’ roles in military interrogations. (shrink)

O artigo tem como objetivo analisar alguns elementos da passagem do jovem Karl Marx, especificamente seus experimentos poéticos influenciados pelo romantismo, ao hegelianismo ainda em meados dos anos de 1837-38 até o início dos anos 40, ou seja, dois anos após ele entrar na universidade e um período pouco tratado pelos estudiosos apologistas ou críticos de sua obra. Buscaremos aqui investigar em que medida essa transição do jovem, a partir de seus 19 para 20 anos, para o hegelianismo – e (...) a forma como essa apreensão se deu – teve influência na constituição de sua concepção posterior, conjuntamente com Friedrich Engels, para a mesma crítica feita à filosofia de Hegel e os grupos pós-hegelianos nos anos seguintes. No final, evidenciaremos não apenas em que medida essa expressão romântica influenciou o modo como o jovem Karl Marx aderiu a filosofia hegeliana, senão também o que se conservou em sua crítica e concepção posterior.
